Welcome to Tiny Arc. These Terms & Conditions ("Terms") govern your access to and use of the Tiny Arc mobile application ("App") operated by Tiny Arc ("we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Definitions

"User", "you", or "your" refers to any individual who downloads, installs, or uses the App. "Content" means any data, text, entries, or information you create or submit through the App. "Services" means all features, tools, and functionality provided by the App.

2. Eligibility

You must be at least 16 years of age to use this App. By using the App you represent and warrant that you meet this age requirement. If you are under 18 you confirm that you have obtained consent from a parent or legal guardian.

3. Account Registration

Certain features require you to create an account. You agree to provide accurate and complete information, keep your credentials confidential, and notify us promptly of any unauthorized access. You are responsible for all activity under your account.

4. Description of Services

Tiny Arc provides personal health and wellness tracking tools including, but not limited to:

Mood logging and analytics
Sleep tracking
Food and nutrition logging, barcode scanning, and calorie tracking
Water intake tracking
Symptom and lifestyle tracking
Weather-based mood correlation insights
AI-assisted mood predictions and food recommendations
Weekly digest reports and trend analysis
Achievement and streak systems
Daily journaling

5. Subscriptions & In-App Purchases

The App offers both free and premium features. Premium features are available through in-app subscriptions managed via Apple App Store or Google Play Store ("Store").

Subscription prices are displayed in the App before purchase and may vary by region.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel subscriptions through your Store account settings.
Refund requests are handled according to the policies of the relevant Store.

6. Advertising

The free tier of the App displays advertisements provided by third-party ad networks, including Google AdMob. These networks may collect certain device identifiers and usage data in accordance with their own privacy policies. You may remove advertisements by subscribing to a premium plan.

7. User Content & Data

You retain ownership of all Content you submit. By using the App you grant us a limited, non-exclusive licence to process your Content solely to provide and improve the Services. 8. Health Data

The App lets you log health-related information such as sleep, mood, symptoms, and nutrition. We do not use this data for advertising, marketing, or data mining. It is transmitted securely to our servers solely for the purpose of providing the Services to you.

9. Location Data

The App may request location permissions to retrieve local weather data for mood correlation features. Location data is used solely for this purpose and is not shared with third parties except weather data providers as necessary to deliver the service.

10. Camera & Barcode Scanning

The App uses camera access exclusively to scan food product barcodes for nutritional information lookup. Images captured during scanning are processed locally and are not stored or transmitted beyond what is necessary to retrieve product data.

11. AI-Powered Features

The App uses algorithmic and AI-based models to generate mood predictions, food recommendations, and wellness insights. These outputs are generated automatically based on your tracked data and general patterns. They are not reviewed by health professionals and should not be relied upon as medical or professional advice.

12. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Attempt to reverse-engineer, decompile, or extract the source code of the App.
Interfere with or disrupt the integrity or performance of the App or its servers.
Use automated systems or bots to access the App.
Impersonate another person or misrepresent your identity.

13. Intellectual Property

The App, including its design, code, graphics, logos, and all related intellectual property, is owned by Tiny Arc and is protected by applicable copyright and trademark laws. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.

14. Third-Party Services

The App integrates with third-party services including weather APIs, food nutrition databases (USDA FoodData Central), and ad networks. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

15. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINY ARC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, HEALTH OUTCOMES, OR ANY DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE APP.

17. Indemnification

You agree to indemnify and hold harmless Tiny Arc from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

18. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall continue to apply.

19. Changes to These Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Croatia.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
